These Terms and Conditions (“Terms”) govern your use of the ToneHone mobile application (the “Service”) operated by Engage Digital Projects Ltd (“we”, “us”, “our”), a company registered in England and Wales.

By downloading, installing, or using ToneHone, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 18 years old to use ToneHone. By using the Service, you represent and warrant that you are at least 18 years of age and have the legal capacity to enter into these Terms.

2. Account Registration

• You may create an account using email, Sign in with Apple, or Google Sign-In
• You are responsible for maintaining the confidentiality of your account credentials
• You are responsible for all activity that occurs under your account
• You must provide accurate and complete information when creating your account
• We reserve the right to suspend or terminate accounts that violate these Terms

3. The Service

ToneHone is an AI-powered conversation assistant that helps you craft dating app replies. The Service includes:

• AI-generated reply suggestions based on your tone profile
• Tone profile configuration and management
• Conversation tracking and insights
• A keyboard extension for in-app reply generation
• A template library for common conversation scenarios

4. Credits & Payments

4.1 Credit System

ToneHone uses a credit-based system. Each AI generation consumes credits. Free credits are provided upon account creation. Additional credits can be purchased via Apple In-App Purchase.

4.2 Purchases

• All purchases are processed through Apple's App Store and are subject to Apple's terms
• Prices are displayed in your local currency as determined by the App Store
• Credits are non-transferable between accounts
• Purchased credits do not expire

4.3 Refunds

Refund requests for In-App Purchases must be directed to Apple through their standard refund process, as all payments are processed by Apple. We do not process refunds directly.

5. AI-Generated Content

5.1 Nature of AI Content

• AI-generated suggestions are provided as starting points, not final messages
• You are solely responsible for any messages you choose to send, whether AI-assisted or not
• AI suggestions may occasionally be inaccurate, inappropriate, or not match your intended tone
• We recommend reviewing and personalising all suggestions before sending them

5.2 No Guarantee of Outcomes

ToneHone does not guarantee any particular outcome from using AI-generated suggestions. We do not promise that using the Service will result in more matches, dates, or romantic success. The Service is a communication tool, not a dating guarantee.

5.3 Ownership of Generated Content

You own the rights to any messages you compose using ToneHone, including those derived from AI suggestions that you have modified. We retain no rights to messages you send to others.

6. Acceptable Use

You agree NOT to use ToneHone to:

• Harass, threaten, intimidate, or harm any person
• Send unsolicited, abusive, or offensive messages
• Impersonate another person or misrepresent your identity in a harmful way
• Generate content that is sexually explicit involving minors, or that promotes violence
• Violate the terms of service of any dating platform you use
• Conduct any form of fraud, scam, or deceptive practice
• Attempt to reverse-engineer, decompile, or extract the AI models or prompts
• Use automated systems to access the Service (bots, scrapers, etc.)
• Circumvent rate limits, credit systems, or security measures
• Share your account credentials with others or operate multiple accounts

Violation of these terms may result in immediate account termination without refund.

7. Intellectual Property

• The ToneHone app, including its design, code, algorithms, and branding, is owned by Engage Digital Projects Ltd
• The ToneHone name, logo, and related marks are our trademarks
• You are granted a limited, non-exclusive, non-transferable licence to use the app for personal, non-commercial purposes
• You may not copy, modify, distribute, or create derivative works of the app

8. Privacy

Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review it carefully.

9. Third-Party Services

ToneHone integrates with third-party services including Apple (authentication, payments), OpenAI (AI generation), and Supabase (infrastructure). Your use of these services is subject to their respective terms and privacy policies. We are not responsible for the practices of third-party services.

10. Service Availability

• We aim to provide uninterrupted service but do not guarantee 100% uptime
• The Service requires an internet connection to function
• We may perform maintenance, updates, or modifications that temporarily affect availability
• We reserve the right to modify, suspend, or discontinue the Service at any time with reasonable notice

11. Disclaimer of Warranties

The Service is provided “as is” and “as available” without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that AI-generated suggestions will be accurate, appropriate, or effective for your specific situation.

12. Limitation of Liability

To the maximum extent permitted by law, Engage Digital Projects Ltd shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, or goodwill, arising out of or in connection with your use of the Service.

Our total liability for any claims arising from or related to the Service shall not exceed the amount you paid to us in the 12 months preceding the claim.

Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, fraud, or any other liability that cannot be excluded by English law.

13. Indemnification

You agree to indemnify and hold harmless Engage Digital Projects Ltd from any claims, damages, losses, or expenses (including legal fees) arising from your use of the Service, your violation of these Terms, or your violation of any rights of a third party.

14. Termination

• You may terminate your account at any time via the app (Account Settings → Delete Account)
• We may terminate or suspend your account for violation of these Terms
• Upon termination, your data will be handled according to our Privacy Policy
• Sections 5, 7, 11, 12, 13, and 16 survive termination

15. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes via in-app notification or email at least 30 days before the changes take effect. Continued use of the Service after the effective date constitutes acceptance of the updated Terms.

16. Governing Law & Disputes

These Terms are governed by and construed in accordance with the laws of England and Wales. Any disputes arising from or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of England and Wales.

If you are a consumer, you may also have additional rights under the Consumer Rights Act 2015 and other applicable UK consumer protection legislation, which are not affected by these Terms.

17. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
